Purchases from The Gym Industry AS are governed by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act and the E-Commerce Act. These laws give you as a consumer mandatory rights, and the terms here are not to be understood as a limitation of those rights.

Prices and pricing errors

All prices include VAT and are stated in NOK. Shipping is calculated in addition and is shown at checkout before payment is completed. We reserve the right to correct errors in text, images and prices. If an item is incorrectly priced due to a technical or human error, The Gym Industry AS reserves the right to cancel the order and notify the customer. In such cases the customer will receive a full refund.

Payment

We use Shopify Payments as our payment solution. You can pay with VISA, Mastercard, Vipps or Klarna. Payment must be completed in full before the order is processed and shipped.

Separate payment terms can be agreed for business customers. Contact us directly for invoicing and credit agreements.

Order changes

Changes to an order must be reported to us within 24 hours of ordering. After that we cannot guarantee that changes can be made, as the order may be in processing or already shipped.

Order processing

All orders are normally processed within 1 to 3 working days from when the order is received. For commercial orders and larger deliveries we contact you directly to coordinate delivery and timing.

Delivery time

Standard products are normally shipped within 1 to 3 working days. You receive tracking information when the order has been shipped. If you order items that are not in stock, you will be notified by phone or email with an expected delivery date. All delivery times are estimates and not binding promises.

Shipping and delivery

Shipping costs are calculated based on weight, size and delivery address. Products over 35 kg are delivered by freight carrier during the daytime, and we will contact you to agree on a time. Delivery is made to the inside of the door or the specified delivery address. If a delivery attempt cannot be completed, the customer may be charged for a new delivery.

The risk for the goods passes to the buyer at the moment the goods are delivered to the stated address or collected by the buyer.

Damaged goods on delivery

If the goods are damaged on receipt, this must be reported to us at mille@thegymindustry.no within 24 hours of delivery. The report must include photos of the damage and the packaging. We will then give instructions for return and replacement or refund after a specific assessment.

Returns and right of withdrawal

As a private individual you have a 14-day right of withdrawal from when you receive the goods, in accordance with the Right of Withdrawal Act. The goods must be returned in original condition and packaging. Return shipping is paid by the buyer. Contact us at mille@thegymindustry.no to start a return. You can also deliver the equipment in person to our showroom in Sandvika.

Goods that are custom-made or adapted to the customer's specifications cannot be returned unless they are defective on delivery.

Complaints

If you experience faults or defects with the product, contact us at mille@thegymindustry.no as soon as possible. You can make a complaint for up to two years after purchase, as long as you notify us within a reasonable time after the defect is discovered. If we are unable to replace with an equivalent product, we refund the purchase price.

Warranty

All equipment from SHUA Fitness and XMaster Fitness is covered by a manufacturer's warranty. Warranty terms are shown on each product page. Normal wear, discolouration and visual damage that occurs over time are not covered by the warranty. For questions about the warranty, contact us directly.

Risk and insurance

The risk for the goods, including responsibility for theft, damage or loss, passes to the buyer on delivery. The Gym Industry AS is not liable for damage or loss that occurs after the goods have been delivered.

Age limit

Purchases in our online store can only be made by persons over 18 years of age.

Personal data

The information you provide when purchasing is used to process your order and keep you updated on its status. We do not share your information with third parties beyond what is necessary to complete the delivery. Read our privacy policy for more information.

Retention of title

The Gym Industry AS retains title to delivered goods as security for the purchase price until it has been paid in full. Goods subject to retention of title may not be resold, pledged or disposed of without our consent, cf. the Norwegian Mortgages and Pledges Act (LOV-1980-02-08-2).

Unforeseen events (force majeure)

The Gym Industry AS is not liable for delays or non-delivery caused by circumstances beyond our control, including strikes, fire, theft, pandemics, war or natural disasters. In such events we may suspend or partially deliver orders, and we will notify the customer as soon as possible.

Disputes

Disputes are to be resolved amicably where possible. If this is not successful, the decisions of the Norwegian Consumer Disputes Commission are followed, with Oslo District Court as the legal venue.
